Inheritance Calculation According to Shaykh Salih al-Fawzan

Faraidh scholarship drawn from two works by Shaykh Salih ibn Fawzan al-Fawzan: at-Tahqiqat al-Mardhiyyah (his academic thesis) and al-Mulakhkhash al-Fiqhi. Sixteen files: tiered theory, a calculation engine, the full grandfather-with-siblings (muqasamah) system — including al-Akdariyyah and al-mu’addah — plus a direct comparison with the Ibn Uthaymin track.

The core rules of faraidh (fixed shares, ‘asabah, hajb, ‘awl/radd/tashih) are agreed upon across textbooks — what sets the al-Fawzan track apart is its academic completeness: at-Tahqiqat teaches the full madhhab system, including the hardest chapter that condensed texts tend to trim: the grandfather inheriting alongside siblings via muqasamah (the best of muqasamah / 1/3 / 1/6, bases 18 and 36, al-Akdariyyah, al-mu’addah). Interestingly, al-Fawzan’s own tarjih actually matches Ibn Uthaymin’s — siblings are excluded by the grandfather (Tahqiqat pp. 135–140) — yet he still equips his readers with the full system, and this bundle follows that same approach.

Key points:

• All non-grandfather rules are identical to the Ibn Uthaymin bundle — this bundle focuses on its added value.
• Muqasamah: the grandfather is counted as a brother (2 heads); he takes whichever is best for him — muqasamah vs. 1/3 of the estate (with no other fixed-share heirs) or muqasamah vs. 1/3 of the remainder vs. 1/6 (with other fixed-share heirs present); never less than 1/6.
• Al-Akdariyyah (husband + mother + grandfather + 1 sister): the one and only ‘awl in the grandfather chapter — 6→9→27.
• The disagreement over the grandfather-siblings question can swing by hundreds of millions of rupiah (chapter 11 works out both versions side by side) — staying on one consistent line within a single division is an ethical necessity.
• For official practice in Indonesia, always cross-check against the KHI/Religious Courts (chapter 13).
